Terms of Service

AUTOSONIX, LLC

These Terms of Service (“Terms”) govern access to and use of AutoSonix, LLC.’s (“AutoSonix,” “we,” or “us”) vehicle signal analysis platform, hardware, software, mobile applications, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms.

1. Description of Services

AutoSonix provides dealership- and auction-focused vehicle signal analysis tools, including:

  • Acoustic pattern modeling
  • OBD diagnostic data processing
  • Environmental normalization
  • Statistical signal-alignment metrics, including PTX™ (Powertrain Index)

PTX™ outputs are data-derived statistical indices generated from acoustic and diagnostic inputs.

The Services are designed as operational decision-support tools and are not substitutes for physical vehicle inspections or mechanical expertise.

2. Informational Nature of PTX™

PTX™ outputs:

  • Are statistical signal-alignment models
  • Reflect pattern comparisons against reference datasets
  • Provide probabilistic alignment indicators

PTX™ does not:

  • Diagnose mechanical conditions
  • Identify specific component failures
  • Guarantee future vehicle performance
  • Certify vehicle safety
  • Replace physical inspection
  • Constitute a warranty evaluation
  • Serve as a regulatory compliance certification

Users remain solely responsible for vehicle inspection, repair decisions, resale representations, and compliance with applicable laws.

3. No Professional Advice; Independent Judgment Required

The Services are provided for informational and operational support purposes only.

AutoSonix makes no representation that:

  • PTX™ predicts breakdowns
  • PTX™ eliminates mechanical risk
  • PTX™ guarantees resale value

Users must exercise independent professional judgment when evaluating vehicle condition.

Reliance solely on PTX™ outputs without independent inspection is done at the user’s own risk.

4. No Consumer Reporting Agency Status

AutoSonix is not a “consumer reporting agency” under the Fair Credit Reporting Act (FCRA).

The Services do not:

  • Provide consumer reports
  • Evaluate creditworthiness
  • Determine insurance eligibility
  • Make employment decisions

The Services are not intended for use in any decision governed by FCRA or similar laws.

5. AI and Model Transparency

The Services incorporate machine-learning and statistical modeling techniques.

Outputs may evolve as datasets expand and models are refined.

Model outputs depend on:

  • Data quality
  • Environmental conditions
  • Device integrity
  • Proper scan procedures

AutoSonix does not guarantee outputs will be error-free, complete, or predictive of future outcomes.

6. Authorized Use and Location Verification

The Services are licensed for use at authorized dealership or auction locations only.

AutoSonix may collect geolocation data at the time of scan events as described in the AutoSonix Privacy Policy to:

  • Verify authorized usage
  • Prevent unauthorized redistribution
  • Enforce contractual limitations

Use of the Services outside authorized locations may result in suspension or termination.

7. Marketing & Representation Restrictions

Users may not:

  • Represent PTX™ as a diagnostic tool
  • Represent PTX™ as certifying mechanical safety
  • Represent PTX™ as guaranteeing vehicle condition
  • Use PTX™ outputs in consumer-facing advertising without clear disclosure that the output is a statistical index

Users are solely responsible for representations made to customers, regulators, or third parties regarding vehicle condition.

8. Data Use and Privacy

Collection and processing of information are governed by the AutoSonix Privacy Policy.

AutoSonix acts as a Service Provider in many instances and does not sell or share personal information for cross-context behavioral advertising.

AutoSonix may use de-identified or aggregated data for:

  • Model training
  • System improvement
  • Statistical research
  • Industry benchmarking

9. Intellectual Property

All software, algorithms, models, signal processing methods, and PTX™ indices are the exclusive property of AutoSonix.

Users may not:

  • Reverse engineer the Services
  • Extract model parameters
  • Redistribute outputs outside authorized use
  • Copy or replicate PTX™ scoring methodologies

PTX™ is a trademark of AutoSonix, LLC.

10. Limitation of Liability

To the fullest extent permitted by law:

  • AutoSonix shall not be liable for:
  • Mechanical failures
  • Repair decisions
  • Resale value disputes
  • Warranty claims
  • Regulatory determinations
  • Business losses arising from reliance on outputs

In no event shall AutoSonix’s total liability exceed the amount paid for Services in the preceding twelve (12) months.

11. Indemnification

Users agree to indemnify and hold harmless AutoSonix from claims arising from:

  • Representations made about vehicle condition
  • Misuse of PTX™ outputs
  • Failure to conduct independent inspections
  • Violation of applicable laws

12. Modifications

AutoSonix may modify the Services or these Terms at any time.

Material changes will be posted with an updated Effective Date.

Continued use constitutes acceptance.

13. Governing Law

These Terms shall be governed by the laws of the State of Pennsylvania county of Lehigh, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the state or federal courts located in Pennsylvania.
